GENERAL TERMS AND CONDITIONS OF SERVICE

These General Terms and Conditions of Service govern the use of the Service Provider’s accommodation and services.

The specific conditions are recorded in a separate Service Contract or Cooperation Agreement concluded with the given travel agents, organizers, guests, etc.

2. CONTRACTING PARTY

The services provided by the Service Provider are used by the Guest.

If the order for services is placed directly by the Guest to the Service Provider, the Guest is qualified as the Contracting Party. The Service Provider and the Guest shall jointly and separately become contracting parties (hereinafter referred to as the “Parties”), provided that the conditions are fulfilled.

If the order for the services is placed by a third party (hereinafter referred to as “Agent”) on behalf of the Guest, the terms of cooperation shall be governed by the contract concluded between the Service Provider and the Intermediary. In this case, the Service Provider shall not be obliged to verify whether the third party legally represents the Guest.


3. METHODS AND CONDITIONS OF USING THE SERVICE

  • ordering the service

The order must always be sent to the accommodation in writing (fax, e-mail, etc.). The accommodation’s contact details can be found in the accommodation’s publications, in the accommodation’s own brochures, and on the website https://hoteldelibab.hu/.
The order must include the Guest’s name, address, exact arrival and departure times, room type, and the exact name of the services (meals, program).
When ordering, the accommodation must be clearly informed of which building of the accommodation, and which category and type of room the Guest’s order applies to.
The accommodation confirms every order in writing (fax, e-mail).

The Contract is created by the written confirmation of the Guest’s written reservation by the Service Provider and is therefore considered a written contract.

A verbal reservation, agreement, modification, or verbal confirmation by the Service Provider does not have contractual value.

  • the validity of offers

Fundus Invest Kft.’s offers – with the exception of Daily Room Rates – are only available to Guests with a limited amount of room capacity.

  • cancellation of service

The Guest undertakes to inform the accommodation in writing of any cancellation, modification or any other change to the services ordered by them prior to the start of the service.

The Contract for the use of accommodation services is valid for a specific period of time.

Any extension of the use of the accommodation service initiated by the Guest requires prior consent from the Service Provider. In this case, the Service Provider may stipulate the reimbursement of the fee for the service already provided.
Any amendment and/or supplement to the Contract requires a written agreement signed by the Parties.


4. TERMS OF CANCELLATION

All individual room reservations:

  • which are not for holidays or special periods can be cancelled free of charge up to 7 days prior to arrival.
  • reservations for holidays or special periods can be cancelled free of charge up to 14 days prior to arrival
  • reservations with a New Year’s Eve package can be cancelled free of charge up to 30 days prior to arrival
  • In case of cancellation within the cancellation deadline or the Guest’s non-arrival without cancellation (no show), our hotel will treat the advance payment as a penalty, or in the case of a bank card guarantee, the advance payment will be charged to the bank card.
  • The cancellation conditions also apply to reservations made within the cancellation deadline.

Group reservations (min. 10 people) can be cancelled free of charge up to 21 days prior to arrival, except for New Year’s Eve package reservations. In case of cancellation within 21 days prior to arrival or in case of no-show, our hotel will treat the advance payment as a penalty, or in case of a bank card guarantee, the amount of the advance payment will be charged to the bank card.

In case of booking within the cancellation deadline free of charge cancellation is not possible.

  • Arrival and departure to the accommodation

Our rooms are available to our Guests from 3:00 PM on the day of arrival, and must be vacated until 11.00 AM on the day of departure. Early arrival and late departure are possible, subject to availability, after prior arrangement with the hotel, for a charge. The exceptions are Easter, the summer high season (07.01.-08.31.) and the end-of-year holidays, between December 20 and January 01, when early arrival and late departure are not possible due to high occupancy!

EARLY ARRIVAL FEE:

10 000 HUF/ room ● Use of the room and wellness facilities from 10:00 AM on the day of arrival on the day of arrival

LATE DEPARTURE FEE:

10 000 HUF/ room ● Use of the room and wellness facilities until 6:00 PM on the day of departure

5. TERMS OF PAYMENT, WARRANTY

The Service Provider shall claim the consideration for the services provided to the Contracting Party at the latest after use, before departure from the hotel, but may also provide the option of post-payment under an individual agreement. The Service Provider is entitled to issue a partial invoice for the services provided by them.

The Service Provider may request an advance payment for the entire amount of the ordered services as a guarantee for the use of the service in accordance with the Contract and the payment of the consideration.

The payment for the ordered services can be made in the following ways:

  • by bank transfer,
  • by online bank card payment via the hotel’s booking interface. Online bank card payments are made via the Barion system. Your bank card details are not sent to our hotel. The service provider, Barion Payment Zrt., is an institution under the supervision of the Hungarian National Bank, its license number: H-EN-I-1064/2013.
  • or on site cash, bank card, and in accordance with the applicable laws by Széchenyi Pihenőkártya (SZÉP card).

Payment with a SZÉP card is only possible if the cardholder is also present on site. If the SZÉP card is not in the name of the Guest using the accommodation and the cardholder is not present on site, we cannot accept the card! In the case of payment with a SZÉP card, in order to ensure legitimate card use, the accommodation may request prepayment of the ordered services and presentation of the Guest’s ID card. We would like to thank you for your understanding.

You can pay with the following SZÉP cards at our hotel: OTP, K&H and MKB

Fundus Invest Kft. reserves the right to request a payment guarantee before the Guest uses the accommodation service ordered by the Guest, but at the latest upon the Guest’s arrival.
In the case of a transfer – unless the contract with the accommodation or the booking agency provides otherwise – the Guest is obliged to credit the amount of the ordered services to the bank account of the relevant accommodation before arrival.

Please include the reservation number on the confirmation in the comments section when making the transfer!

We would like to draw the attention of our dear Guests to the fact that we can only issue the final invoice to the same name and address as the prepayment invoice! If you would like to have your stay to be issued for a company name, please inform our colleagues at the time of booking and request the prepayment invoice to be issued for the same company name as well!


6. GUARANTEE

In case of reservation, our hotel always requests a deposit to guarantee the reservation.

In case of individual reservations:

  • in case of normal packages min. 30% of the reservation value
  • in case of holiday packages and special periods min. 50 % of the reservation value
  • in case of New Year’s Eve packages, 100% of the reservation value
  • by bank transfer within 5 days of the order based on the advance payment letter..
  • In case of a reservation within 5 days, no later than 4 PM on the last working day before the Guest’s arrival.

In case of a Travel Agency the advance payment is 100% of the reservation value minus the commission. The written confirmation of the accommodation becomes effective if the requested advance payment is received by the time specified in the advance payment letter.

In case of booking a room on the day of arrival, the full amount of the reservation must be paid in advance at the reception of our hotel upon arrival, before occupying the room.


7. PRICES

The prices published by Fundus Invest Kft. always include the VAT valid at the time of printing, as defined by law.

However, the prices do not include the the tourist tax (IFA), the rate of which is 700 HUF/ person/ night in 2025 and is to be paid at the location of the service from the age of 18, except for those price offers in which Fundus Invest Kft. specifically states: “the prices shown also include the tourist tax”.

Fundus Invest Kft. reserves the right to chance prices.
The accommodation will announce the currently valid prices in the order confirmation. Information on the current price developments of the accommodation can be found on the Fundus Invest Kft. website https://hoteldelibab.hu/ található.

If there is a change in the tax rate set out in the current VAT law, our prices may change without prior notice.

In the case of booking products subject to special conditions, in the case of booking events, or in the case of booking more than 5 rooms (group), the Service Provider may establish conditions and surcharges that differ from the above, set out in an individual Contract.


8. HALF-BOARD SERVICE

Our half-board service includes a buffet breakfast and a buffet dinner. Our hotel reserves the right to provide a 3-course half-board dinner during periods of lower occupancy, depending on the number of Guests (typically under 30 people), with a choice from a reduced menu.

9. CUSTOM SERVICES

a) Children’s discounts, family accommodation:

None of the rooms of our accommodation can have extra beds!

We can accommodate families in our Connected Classic and Connected Classic Balcony room types.

0 – 2,99 years old  In a cot in the parents’ room FREE OF CHARGE
3 – 9, 99 years old  50% discount from the adult price
10 – 13,99 years old  30% discount from the adult price
14 and above  At the same price as an adult

b) Dogs (15 kg max)

Small dogs (up to 15 kg) can be brought into the hotel’s designated, non-carpeted (wooden floorboards) Classic and Classic balcony rooms under the supervision of the Guest, for a fee (5 500 HUF/ pet/ night). Animals may use the common areas without disturbing the peace of other hotel Guests, and only to access the hotel room. Other areas, such as the restaurant, beer bar, entire wellness area, and fitness room, should not be visited by pets, even under the supervision of the Guest! The Guest is fully responsible for any damage caused by the pet they brought in. The hotel management reserves the right to refuse further accommodation of the animal in the hotel if it deems that the animal disturbs the proper operation of the hotel or the peace of other hotel Guests.

c) Parking

There is an open, unguarded street parking in front of the hotel. Parking spaces are limited (approx. 80) and advance reservations are not possible. Please note that during peak periods (holiday weekends, summer months) free parking lots often can be found only about 100-400 meters from the hotel due to the large number of Guests arriving in the city.

d) Medical services

In the case of medical services used in the hotel, a fee in accordance with applicable laws must be paid.


9. COMPLAINTS

In the event of any complaints arising during the hotel service, the Guest may lodge a complaint in writing at the hotel reception until the time of departure. The Guest’s right to complain ceases after departure from the accommodation.
The hotel is obliged to investigate complaints and respond to them in a meaningful manner within 30 days.


10. CEASING OF OBLIGATION TO PROVIDE SERVICES

The Service Provider is entitled to terminate the Agreement for accommodation services with immediate effect, thus refusing to provide the services, if:

  • the Guest does not make proper use of the room or facilities provided,
  • the Guest behaves in a manner that is inappropriate, rude, abusive, under the influence of alcohol or drugs, threatening, abusive or otherwise unacceptable to the security, orderliness or staff of the accommodation,
  • the Guest suffers from an infectious disease,
  • or the Contracting Party fails to fulfill their obligation to make the advance payment provided for in the Contract by the specified date


11. ILLNESS OR DEATH OF THE GUEST

  •  If the Guest falls ill during the period of using the accommodation service and is unable to act in their own interest, the Service Provider will offer medical assistance.
  • In the event of the illness/death of the Guest, the Service Provider shall claim compensation from the relatives, heirs or bill payers of the sick/deceased person for any medical and procedural expenses, the value of services used prior to the death, and any damage to equipment and furnishings caused by the illness/death.


12. RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTY

Under the contract, the Guest is entitled to the intended use of the ordered room and those facilities of the accommodation that are included in the standard range of services and are not subject to special conditions.

The Contracting Party shall pay the consideration for the services ordered in the Contract by the date and in the manner specified in the Contract.

The Guest may not bring their own food and drink to the catering units at the accommodation.


13. RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER

The service provider is entitled to reimbursement for the value of the services ordered by the guest.

The service provider is obliged to provide the accommodation and other services ordered based on the Contract in line with the valid stipulations and service standards


14. COMPENSATION

The accommodation is liable for any damage caused by it in accordance with applicable laws.

The Service Provider is only responsible for valuables, securities and cash if it has expressly accepted them for safekeeping or has refused to accept them for safekeeping.

The Service Provider’s liability does not extend to damages that occurred due to unavoidable causes beyond the control of the Service Provider, its employees and guests, or that were caused by the Guest themselves.
If the guest fails to file a complaint on site, they will not be entitled to compensation later.

The guest is liable for all damages suffered by the Service Provider or a third party due to the fault of the Guest or their companions or other persons under their responsibility. This liability exists even if the injured party has the right to claim compensation for their damages directly from the Service Provider.


15. SECRECY

The Service Provider shall proceed according to the standards determined by the Data Handling Guide.


16.
FORCE MAJEURE

Any reason or circumstance (for example; war, fire, flood, inclement weather, power outage, strike) beyond the control of the Party (force majeure) excuses any Party from performing the obligations set in the Contract prior to this reason or circumstance existing. Parties agree to do everything in their power to limit the possibility of these reasons or circumstances occurring and to remedy the damage or delay caused by them as soon as possible.


17. JURISDICTION, GOVERNING LAW

The legal relationship between the Service Provider and the Contracting Party shall be governed by by the local law (Hungarian law). In any legal dispute arising from the service contract, the court is authorised at the location where the services are provided and declared to have competence to handle the issue. Jurisdiction is in the place where the service was rendered.
